Apartments Queensland reserves the right to amend these terms and conditions of use (including privacy policies) at any time and members/users should review these on a regular basis. This right to amend shall not extend to the suburb/postcode exclusive management rights assigned to members/representatives under their respective agreements with Apartments Queensland.
Terms and conditions shall be read very carefully prior to the use of this website by any party whereby such use shall be considered as acceptance of the terms and conditions below. Any party that is not prepared to accept each and every provision should exit.
Apartments Queensland is a property portal only and will at all times act diligently and with all due care, but accepts no responsibility whatsoever for, and no party shall make any claim or any loss and/or damage suffered directly or indirectly as a result of using or viewing this website, or any material published by, through or linked to the same. Apartments Queensland is excluded to the fullest extent permitted by law from any responsibility and/or liability for any such loss/damage, and all conditions and /or warranties implied by the Trade Practices Act 1974 (Commonwealth) and/or the Fair Trading Act 1989 (Queensland) are hereby negatived. All parties agree that the liability of Apartments Queensland that cannot be so negatived is limited to a resupply of the service provided.
All parties agree to indemnify and keep indemnified Apartments Queensland against all liabilities including legal costs or a full indemnity basis, as a result of any legal proceedings brought against Apartments Queensland by any third party in respect of your published material.
Apartments Queensland gives no assurances that defects or errors will not occur in the website, that it’s ISP will operate at all times without technical failures, or that it will be unaffected by viruses. All parties acknowledge that errors and delays can occur in the transmission of data over the internet. All parties acknowledge that the format of the website can change at any time without notice to you.
Apartments Queensland will not be obliged to monitor or censor the material submitted, but reserves the right at its sole discretion, to edit any such material, or to refuse to publish any material.
Apartments Queensland member agents agree to adhere to the privacy act statement and provisions displayed on this website.
Apartments Queensland makes no representations and gives no assurances that any advertisement will succeed, nor what responses may result, nor even the likelihood of any hits.
Apartments Queensland gives no warranties in relation to any material published, or the ownership, availability, suitability, fitness or quality of any property advertised on the website.
All parties advertising properties on the Apartments Queensland website agree to advertise only properties that are currently available for sale, to remove a property within 24 hours of a sale contract becoming unconditional, to ensure that submitted material is correct in every respect, that the material will not offend any of the laws of Australia, its states and territories, and will not contain anything that could expose Apartments Queensland to legal proceedings or sanctions.
All individual parties/member agents exercising use of the exclusive management services for their postcode areas will operate within the boundaries of the shown map and as individually contracted for the display of properties in accordance with their licence agreement, but this provision shall exclude commercial developers and rental properties including holiday accommodation. All other representatives will adhere to these terms and conditions.
Sellers may only advertise their property on Apartments Queensland through their area member agents or representatives.
Apartments Queensland gives no warranties with respect to those service providers displayed on this portal.
Apartments Queensland reserves the right to on forward all information supplied by members/representatives to this website to a third party. This provision shall include the possible linking of this website to other sites.
All users of Apartments Queensland acknowledge and agree that Apartments Queensland does not exert control over those parties viewing and using the website and Apartments Queensland is not liable for their opinions or their behaviour including all information or advice provided by them and/or any defamatory statements or offensive conduct.
All third party advertising, including other website links, banner adverts, tower adverts, blog entries etc are not recommendations or endorsements by Apartments Queensland or its associated entities or their respective directors or employees unless expressly shown otherwise. All parties should refer to the third party advertiser with respect to the information products or services being supplied.
All members and sellers agree to pay the fee notified to them, in advance and Apartments Queensland thereupon agrees, subject to the above terms and conditions, to publish advertisements on this website for the agreed period. In the event that you wish to re-advertise, then these same conditions apply again.
All parties agree that the above comprises the entire agreement between Apartments Queensland and the contracted parties, that the contracted parties cannot assign the agreement without the written consent of Apartments Queensland, that any notices between both parties be emailed, that the law of Queensland governs this agreement, that only Queensland courts have jurisdiction and that any delay in enforcing any of the provisions of this agreement are not to be construed as a waiver of those provisions.

Delivery and Refund Policy
We will normally confirm receipt of your membership within 24 hours.

All services shall be delivered in accordance with the terms and conditions herein. In the event that such internet services are not provided all fees paid by sellers and members shall be refunded within 24 hours.

All content and layout of the Apartments Queensland website provided by Apartments Queensland including graphics, logos, icons and any text shall be copyright 2009 Apartments Queensland.
The above shall be protected by Australian and international copyright laws. Any content published must not be modified, copied, republished/reproduced and only forwarded by Apartments Queensland members/representatives as contracted in writing under their respective licence agreements.
Any content forwarded shall remain intact and in the same form as represented on the website.
This website must not be used for any purpose which is unlawful.
This website maybe linked to other websites but only with the express consent of Apartments Queensland with such consent to be in writing.
